Judge Rules Against Insurance Company In Chinese Drywall Case!

Judge Robert Foster ruled against an Odessa Florida homeowner's insurance company by making use of the Insurance company's own policy language as the basis for his decision.

Judge Foster reviewed the case submitted by the Insurance company denying the claim based on the drywall being a "defective building material" and causing "wear and tear" on the components of the home.  He ruled that the drywall itself was not defective as it did serve its purpose as a finishing material for the interior of the home.  However, he decided that the corrosive nature of the drywall by emitting "gases" is covered under the same provision of the homeowner's insurance policy that covers "smoke" damage. 

This ruling is expected to spark several new cases being submitted by homeowner's left with nowhere else to turn.

How Should I Prepare For A Home Inspection?

KNOW THE ANSWERS TO THE FOLLOWING QUESTIONS BEFORE CALLING KROSS INSPECTORS: 

1. When does the Inspection period expire on your contract?  If you do not know, ask your Realtor!  We will make sure to have your inspection complete and results delivered before this important deadline!
2. Is Electricity & Water service available at the property for our Inspection? Electricity and water are important to determine the condition of many components.  Without these services, we must exclude many items from our Inspections.  You may not be able to make a complete informed decision about the purchase.  If you do not know the answer, ask your Realtor! If these services are not available, your Realtor may be able to obtain an extension of your Inspection period!
3. Who are the contacts for the Inspection Assignment?
   • Client(s) Name, Address, Telephone, & Email
   • Realtor's Name, Telephone, & Email
4. Who should receive copies of the Inspection Report? (Names and Email addresses)
5. Will you need a hard copy of your Inspection Report printed?  Letting us know up front saves time and generates an automatic process that makes your report available for printing right away.
